Hereinafter: the “Seller”.
Fishki is an educational application being developed for medical students. Its purpose is to make creating flashcards, studying with reviews, working with visual materials and planning study for tests, exams and final exams easier.
Fishki is a product under development. The subject of this agreement is the preorder of an annual Fishki Premium subscription, not access to a test version or the purchase of a finished app on the payment date.
The subject of the agreement is a preorder for a 12-month Fishki Premium subscription. The subscription period starts on the public launch date, when Fishki becomes available to all users. The purchase does not start the paid Premium period before that date.
The buyer makes a one-time payment for one 12-month Premium period. The preorder does not renew automatically or create further payments.
Before public launch, the Seller may additionally invite the buyer to free, private beta testing on a selected platform. Participation is voluntary, depends on invitation availability, and is neither the subject of the sale nor a condition for starting or retaining the Premium subscription. Purchasing the preorder does not guarantee a beta invitation.
No invitation, declining testing or the end of testing does not shorten the purchased 12 months of Premium from public launch.
The preorder price depends on the user's region and is: PLN 69 in Poland, €16.99 in Europe outside Poland or $18.99 in the United States and other countries.
The planned annual price after the public launch is respectively: PLN 149 in Poland, €49.99 in Europe outside Poland or $59.99 in the United States and other countries.
This is a one-time payment solely for the preorder of a 12-month Fishki Premium subscription. Any beta testing invitation is free.
The Seller may change the preorder price or end its sale in the future. A price change does not affect people who purchased the preorder before the change.
The public launch of Fishki is planned by the end of 2026. The purchased 12-month Fishki Premium period starts on that date.
The full version of the application means that Fishki is made publicly available to all users. This term does not guarantee the implementation of any specific feature or an unchanged feature scope, as Fishki will continue to evolve after its public launch.
The planned launch date may change because the application is still under development.
If the application does not officially launch by March 31, 2027, every purchaser may request a full refund of the amount paid for the preorder within two months of that date.

This list describes the product direction and does not guarantee that every feature will be available on the public launch date. The right to use the Premium plan for 12 months remains the subject of the agreement.
If the Seller invites the buyer to free, private beta testing, the test version:
Beta testing may change or end before launch. Participation is not a paid service and does not affect the buyer’s rights under the Premium preorder.

After payment, the buyer will see an order confirmation; the payment provider may email a transaction confirmation to the address provided. The Seller will share details of the purchased Premium subscription before or on the public launch date.
The buyer should provide a current and accurate email address. It will be used to link the Premium subscription and communicate about the preorder, any free beta testing invitation, refunds and complaints.
A user who is a consumer may withdraw from the agreement within 14 days of purchasing the preorder without giving a reason.

I withdraw from the agreement to preorder a 12-month Fishki Premium subscription. Please refund the payment. Email address used for the purchase: [email address].
The refund will be made using the same payment method used for the purchase unless the parties agree on another refund method.
Independently of the statutory right of withdrawal, the Seller grants the user an additional right to a refund.
If the application does not officially launch by March 31, 2027, the user may request a full refund of the amount paid for the preorder within two months of that date.

The refund covers the amount actually paid by the user for the preorder.
The Seller may contact the user regarding:

The user may submit a complaint concerning the preorder or the application by sending a message to:

The Seller will respond to the complaint within 14 days of receiving it.
The user’s personal data is processed to handle the Premium preorder, payment, linking the 12-month subscription from public launch, possible free beta testing invitations, communications, refunds and complaints.

The Seller may amend these terms, in particular in the event of:
Changes will not worsen the position of users who purchased the preorder before the changes took effect unless the change results from applicable law.
Polish law applies to matters not regulated by these terms.
