Fishki Terms of Use

These Terms of Use govern the use of the Fishki website available at:

https://www.fishki-med.com/

and, once it becomes available, the Fishki application.

The owner and operator of the website is:

Hereinafter: the “Operator”.

The Fishki website is used to:

• present the planned educational application,
• show an interactive demo,
• collect waitlist registrations,
• sell the Fishki Early Access preorder,
• provide information about product development.

The content on the website is informational and marketing material. It does not constitute medical, legal, tax or educational advice.

The demo available on the website shows the direction of product development and an example of how the application may work.

The demo:

• is not the final version of the application,
• may run only locally in the browser,
• may have limited features,
• may differ from the future version of the application,
• may contain simplified sample data.

The Operator may change, limit or remove the demo at any time.

A user may join the waitlist by providing the required information, in particular an email address.

Joining the waitlist is free and does not oblige the user to purchase the application.

People on the waitlist may receive messages about:

• Fishki development,
• the application launch,
• testing opportunities,
• surveys and product questions,
• Fishki-related offers.

The user may unsubscribe at any time by clicking the unsubscribe link in an email or contacting the Operator.

The purchase of the Fishki Early Access preorder is governed by a separate document: the Fishki Early Access Preorder and Sales Terms.

If these Terms of Use conflict with the Preorder Terms, the Preorder Terms take precedence for matters concerning the preorder purchase.

Once released, Fishki may require the user to create an account.

The user agrees to provide accurate information and secure access to their account.

The user should not share login details with third parties.

The Operator may block or restrict account access if the user violates these Terms, the law or the rights of others.

After the application launches, users may create, add or store their own educational materials, including flashcards, text, images, notes, decks or other content.

The user is responsible for materials added to the application and represents that they hold the rights or permissions required to use them.

Users may not add materials that:

• violate the law,
• infringe copyright or other third-party rights,
• contain unlawful, offensive or discriminatory content,
• contain third-party personal data without a legal basis,
• circumvent application security,
• disrupt the application.

The website, Fishki name, interface elements, text, graphics, logo, website layout, code and other elements created by the Operator are protected by law.

The user does not acquire intellectual property rights to Fishki beyond the right to use the website or application in accordance with these Terms.

The user retains the rights to their own materials added to the application.

By adding materials, the user grants the Operator a non-exclusive, royalty-free technical licence to store, process and display them only to the extent required for the application to operate.

The user may not:

• use the website or application unlawfully,
• attempt unauthorised access to the Operator's systems,
• copy, reverse engineer or decompile the application where doing so would violate the law,
• automatically download website content without the Operator's consent,
• disrupt the website or application,
• use Fishki to distribute malware,
• violate the rights of other users.

The Operator will take reasonable steps to keep the website and application working properly but does not guarantee uninterrupted availability of the website, demo or application.

They may be temporarily unavailable because of:

• technical work,
• failures,
• infrastructure changes,
• actions of third parties,
• circumstances beyond the Operator's control.

The Operator may develop, change, remove or add application features.

Fishki is an educational tool.

Content in the application, demo or user materials does not constitute medical, diagnostic or therapeutic advice.

Users should independently verify educational materials, especially when studying for exams, participating in clinical practice or working with patients.

The Operator is liable to consumers in accordance with applicable law.

To the extent permitted by law, the Operator is not liable for:

• errors in user-added materials,
• consequences of studying from unverified materials,
• data loss caused by the user's actions,
• technical interruptions,
• decisions based on content available in the application,
• failure to achieve a particular educational result.

Nothing in these Terms limits consumer rights arising from mandatory provisions of law.

Complaints concerning the website or application may be sent to:

A complaint should include:

• information identifying the user,
• a description of the issue,
• the expected solution.

The Operator will respond within 14 days of receiving the complaint.

The rules for processing personal data are described in the Privacy Policy.

The Operator may change these Terms, in particular because of:

• changes to website or application features,
• the launch of new services,
• changes in law,
• changes to the Operator's details,
• the need to clarify the rules for using Fishki.

The new version of the Terms will be published on the website.
